1. Scope<\/h2>\n\n\n

These General Terms and Conditions (GTC) govern the rights and obligations between Fitcom AG and its customers.<\/p>\n\n\n

By placing an order or issuing a commission (via online shop, telephone, or email), these terms and conditions are automatically accepted.<\/p>\n\n\n

Any deviations from these Terms and Conditions are effective only if confirmed in writing by Fitcom AG.<\/p>\n\n\n

2. Conclusion of Contract and Binding Effect<\/h2>\n\n\n

For online orders, an order is binding as soon as the customer has completed the ordering process and selected a payment option. This applies to direct payments (credit card, PayPal, etc.) as well as to advance payment and purchase on invoice for private individuals.<\/p>\n\n\n

For orders placed by email or phone, the sales contract does not become legally effective and binding until Fitcom AG sends the invoice.<\/p>\n\n\n

Fitcom AG reserves the right to reject orders without providing a reason.<\/p>\n\n\n

3. Offers and Prices<\/h2>\n\n\n

All prices are in Swiss Francs (CHF) and include statutory VAT.<\/p>\n\n\n

Prices are subject to change; errors and misprints may occur. In the event of obvious pricing errors, Fitcom AG reserves the right to rescind the contract and make a correction.<\/p>\n\n\n

If the ordered product is not available, the customer will be notified immediately. In this case, an immediate refund or the option of subsequent delivery (provided the product is available again) will be offered. There is no entitlement to compensation for damages.<\/p>\n\n\n

Fitcom AG sells fitness products. The condition and quality level (e.g., entry-level quality) are specified in the product description. Claims regarding explicitly mentioned features will not be accepted.<\/p>\n\n\n

Products may differ slightly from the description or product image. The color of the delivered product may differ from the color shown in the image. For weight-based products (e.g., kettlebells, dumbbells, barbells, medicine balls, etc.) and for dimensions, deviations of up to 5% are considered minor.<\/p>\n\n\n

4. Payment<\/h2>\n\n\n

The following payment methods are accepted: Twint, credit card, prepayment (bank transfer) and invoice (private customers).<\/p>\n\n\n

\nPurchase on account for private individuals (including installment payment) is processed by CembraPay AG. The are applicable<\/span>\n\n\nTerms and Conditions<\/a>\n\n\nand the<\/span>\n\n\nPrivacy Policy<\/a>\n\n\nof CembraPay AG.<\/span>\n<\/p>\n\n\n

The goods remain the property of Fitcom AG until full payment has been made.<\/p>\n\n\n

5. Retention of title<\/h2>\n\n\n

Fitcom AG reserves title to the purchased item:<\/p>\n\n\n

\nAmong consumers:<\/strong>\n\n\nuntil full payment of the purchase price<\/span>\n\n\n
<\/span>\n\n\nFor entrepreneurs and legal entities:<\/strong>\n\n\nuntil all outstanding claims from the business relationship have been settled<\/span>\n<\/p>\n\n\n

Set-off is permissible only with counterclaims that are legally established, undisputed, or acknowledged. Rights of retention exist only in the case of counterclaims arising from the same contractual relationship.<\/p>\n\n\n

In the event of payment default, all claims shall become due immediately.<\/p>\n\n\n

6. Delivery and Shipping<\/h2>\n\n\n

Delivery times are non-binding and are for guidance only.<\/p>\n\n\n

Freight forwarding goods are delivered to the curb. Smaller packages are delivered depending on the selected delivery option. Delivery of freight goods to the apartment\/floor can be booked for an extra charge and subject to availability. Please contact us for prices.<\/p>\n\n\n

\nTransfer of risk:<\/strong>\n\n\nRisk passes to the customer as soon as the goods have been delivered. The customer is responsible for specifying the correct delivery options (e.g., leaving the package with a neighbor or at a specific location). Fitcom AG is not liable for theft, damage, or loss after delivery has been completed.<\/span>\n<\/p>\n\n\n

Shipping partners are Swiss Post and\/or Planzer.<\/p>\n\n\n

7. Returns and Right of Withdrawal<\/h2>\n\n\n

\nCancellation before shipping:<\/strong>\n\n\nA withdrawal from the purchase contract is only possible as long as the goods have not yet been dispatched.<\/span>\n<\/p>\n\n\n

\n100-day return policy:<\/strong>\n\n\n
<\/span>\n\n\nFirst:<\/strong>\n\n\n100 days from order completion<\/span>\n\n\n
<\/span>\n\n\nReturn shipping:<\/strong>\n\n\nAt the customer's expense<\/span>\n\n\n
<\/span>\n\n\nCondition:<\/strong>\n\n\nThe merchandise must be unused, in its original packaging, and in its original condition. If the returned merchandise is not in its original packaging or is not in its original condition, Fitcom AG reserves the right to issue only a partial refund.<\/span>\n\n\n
<\/span>\n\n\nRefund:<\/strong>\n\n\nThe credit will be issued in the form of a discount code or a full refund (return shipping costs excluded).<\/span>\n<\/p>\n\n\n

\nSpecial terms and conditions for purchase on invoice (CembraPay AG):<\/strong>\n\n\n
<\/span>\n\n\nFor orders on account placed by private individuals and processed through CembraPay AG, goods may be returned within the return period specified above. The Terms and Conditions of CembraPay AG also apply. Should customers fall into default due to payment deadlines set by CembraPay AG that differ from our return period, any reminder fees and late payment interest shall be borne by the customer. Fitcom AG assumes no liability for reminder fees incurred by CembraPay AG.<\/span>\n<\/p>\n\n\n

<\/span>\n\n\nRegardless of the right of return, there is a right to exchange or refund in the event of:<\/span>\n\n\n
<\/span>\n\n\nProven defective products (severe defects not mentioned in the product description)<\/span>\n\n\n
<\/span>\n\n\nWrong delivery (different product than ordered)<\/span>\n\n\n
<\/span>\n\n\nFalse information in the product description<\/span>\n<\/p>\n\n\n

8. Warranty and Notice of Defects<\/h2>\n\n\n

All products are subject to the statutory warranty rights in accordance with the Swiss Code of Obligations (Art. 197 et seq. CO).<\/p>\n\n\n

\nNotice of defect:<\/strong>\n\n\nClaims regarding defects must be reported to Fitcom AG in writing no later than 72 hours after receipt of the goods. Missing items must be reported immediately upon delivery of the goods.<\/span>\n<\/p>\n\n\n

In the event of valid complaints regarding defects, Fitcom AG has the right to choose between repair, replacement, or a reduction in the purchase price.<\/p>\n\n\n

If a product includes a guarantee or warranty, this will be expressly stated in the product description and the duration will be explicitly specified.<\/p>\n\n\n

9. Liability and Disclaimer<\/h2>\n\n\n

Liability for quality rests exclusively with the respective manufacturer. Fitcom AG does not perform any incoming inspections of delivered products.<\/p>\n\n\n

Complaints do not release from timely payment.<\/p>\n\n\n

\nClaims for damages are excluded for:<\/strong>\n\n\n
<\/span>\n\n\nErrors in illustrations, prices and texts<\/span>\n\n\n
<\/span>\n\n\nDelayed or non-delivery (unless in cases of gross negligence or intent)<\/span>\n\n\n
<\/span>\n\n\nConsequential damages (e.g., production downtime, data loss, lost orders)<\/span>\n\n\n
<\/span>\n\n\nTechnical disruptions of the website or online shop<\/span>\n<\/p>\n\n\n

In cases of gross negligence, Fitcom AG is liable only for direct damages, limited to the price of the respective delivery or service.<\/p>\n\n\n

Liability for intent remains unaffected.<\/p>\n\n\n

10. Privacy Policy<\/h2>\n\n\n

Data is treated confidentially and in accordance with the provisions of the Swiss Data Protection Act (FADP). The website uses cookies and tracking tools to improve the user experience and for marketing purposes. Customer data is not passed on to third parties, except to our shipping partners for order processing.<\/p>\n\n\n

11. Newsletter and Marketing<\/h2>\n\n\n

12. Copyright<\/h2>\n\n\n

All displayed logos, images, and graphics are the property of their respective companies and are subject to their copyright. All rights reserved.<\/p>\n\n\n

13. Applicable law and jurisdiction<\/h2>\n\n\n

All legal relationships between Fitcom AG and its customers are governed exclusively by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).<\/p>\n\n\n

The exclusive venue for all disputes is CH-4410 Liestal.<\/p>\n\n\n

14. Severability Clause<\/h2>\n\n\n

If individual provisions of these terms and conditions are or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced immediately by the relevant statutory provision.<\/p>\n\n\n

15. Amendments and Validity<\/h2>\n\n\n

By placing an order, the customer accepts the terms and conditions.<\/p>\n\n\n

Oral agreements require written confirmation to be effective.<\/p>\n\n\n

Fitcom AG reserves the right to amend these Terms and Conditions at any time.
