This Privacy Policy explains how Fitcom AG processes personal data when you visit fitcom.ch, use the online store, a customer account, or a form, as well as in connection with orders and payments.<\/p>\n\n\n

2. Scope and Legal Foundations<\/h2>\n\n\n

We process personal data in accordance with Swiss data protection law. To the extent that the General Data Protection Regulation of the European Union is applicable, we base processing activities in particular on the performance of a contract or pre-contractual measures, legal obligations, legitimate interests in the secure and economical operation of our offering, and on consent, where such consent is required.<\/p>\n\n\n

3. Accessing the Website and Server Logs<\/h2>\n\n\n

When accessing the website, technically necessary data is processed. This may include the IP address, date and time, accessed address, amount of data transferred, status code, referring page, as well as information about the browser, operating system, and device. We use this data to deliver the website, ensure stability and security, investigate errors, and prevent misuse.<\/p>\n\n\n

4. Cookies and Similar Technologies<\/h2>\n\n\n

WordPress, WooCommerce, and the website functions used employ technically necessary cookies or comparable storage technologies. In particular, they enable login and security, shopping cart and checkout, language settings, and session maintenance. Examples include WordPress login cookies and WooCommerce session or shopping cart cookies. Session cookies are generally deleted when the browser is closed. 5. Contact forms, e-mail and telephone<\/h2>\n\n\n

If you contact us via a form, by email or by telephone, we will process the information you provide. Depending on the request, this includes your name, email address, telephone number, company, content of the message and technical transmission data. The forms are provided using Fluent Forms. We use this information to process and document your request, for pre-contractual measures and to prevent misuse.<\/p>\n\n\n

6. Customer account, online shop and orders<\/h2>\n\n\n

When registering and using a customer account, we process in particular your name, email address, encrypted access data, billing and delivery addresses, account settings, and information on orders, downloads, and saved product lists.<\/p>\n\n\n

When processing an order, we handle contact and address details, ordered products, prices, delivery and payment methods, order status, communication, and other information necessary for contract fulfillment. This processing serves the purposes of ordering, delivery, customer service, accounting, fraud prevention, and compliance with legal obligations.<\/p>\n\n\n

7. Payments via Payrexx<\/h2>\n\n\n

Payments are processed via services provided by Payrexx AG, Burgstrasse 20, 3600 Thun, Switzerland, and the respective payment method chosen. Currently, American Express, Apple Pay, Google Pay, Mastercard, Reka, TWINT, and Visa, among others, are enabled in the shop via Payrexx. In this context, order references, amounts, currencies, contact details, technical data, and transaction data necessary for the payment are transmitted to Payrexx and participating payment companies. Complete card or account details are generally processed by the payment service providers.<\/p>\n\n\n

\nOn cart and checkout pages, a script from Google can be loaded to provide Google Pay. In the process, Google can receive technical connection data such as IP address, browser information, and the page visited. When selecting Google Pay, the additional terms of<\/span>\n\n\nPrivacy Policy for Google Payments<\/a>\n\n\n.<\/span>\n<\/p>\n\n\n

8. Delivery and further recipients<\/h2>\n\n\n

For the delivery, we pass on the necessary information to commissioned transport and logistics companies. Further recipients may include hosting, IT, maintenance, communication, accounting and consulting service providers as well as public authorities, insofar as the transfer is necessary for the respective purpose or required by law. These entities only receive the data they need for their tasks.<\/p>\n\n\n

9. Sign in with Google<\/h2>\n\n\n

\nOn the WordPress login page, login with Google is offered. If you choose this option, you will be redirected to Google. In the process, Google receives technical connection data and information about the login process. After a successful login, we may receive, in particular, a provider ID, name, email address, and, if applicable, a profile picture from Google. 10. Transfer abroad<\/h2>\n\n\n

Individual service providers or their subcontractors may process personal data outside of Switzerland. In such cases, we ensure adequate data protection, in particular based on a recognized level of data protection, appropriate contractual guarantees, or a statutory exception. For payment services, the exact location of processing also depends on the chosen payment method and the information provided by the respective provider.<\/p>\n\n\n

11. Retention period<\/h2>\n\n\n

We only store personal data for as long as is necessary for the respective purpose, the fulfillment of the contract, security, and statutory documentation and retention obligations. Business and accounting records are generally kept for ten years. We store contact inquiries until they have been fully processed and beyond that as far as this is necessary for documentation or potential claims. Account data is generally stored until the account is deleted, subject to data required by law or associated with orders.<\/p>\n\n\n

12. Rights of Data Subjects<\/h2>\n\n\n

Under the applicable data protection law, you may request access, rectification, erasure, restriction, or portability of your personal data, and object to its processing.
